Man Arrested For OWI Twice in One Night

A 38-year-old Oak Creek man got into an argument with family members who came to pick him up at the police station and drove away, according to a police report.

 

A 38-year-old Oak Creek man was arrested for drunken driving not once, but twice early Friday morning.

An Oak Creek police officer pulled him over about 1 a.m. after he saw him going the wrong way in the 7800 block of S. Howell Ave., according to a police report. He registered a preliminary blood-alcohol content of .20 and was arrested.

After he was released at the Oak Creek Police Department, he got into a heated argument with family members who came to pick him up, according to the report. He made his sister exit the vehicle and began to drive away.

Officers pulled the man over again about 4:50 a.m. After failing sobriety tests and blowing a .17 on the intoximeter, he was arrested for drunken driving for a second time and taken to county jail.

Typically after they get booked at the police station, police turn over the person to someone who is sober (usually a family member) who signs a statement of responsibility. In this case, an argument ensued after the man's family members came to pick him up, and he forced his sister out of the van and drove off, according to the police report.

I'm glad he didn't kill anyone with his assault vehicle...
Why don't we have better drunk driving laws to protect the public from these types of morons? If he killed one of my children driving on the wrong side of Howell we would be doing more than just calling the guy an idiot.

There is simply no room for all the drunks on the road. I know of someone who was supposed to do time in jail after a 2nd OWI....he didn't even spend the whole night due to overcrowding...so I say we need to take some of that money thats burning a hole in Barrett's pocket and create 'drunk houses'. Look at this case where a woman was pulled over and given a speeding ticket 4x in one day (112, 98, 88 and 88mph) ending in WI. SHe also had possession of pot and NO Insurance. So, who would we blame if she killed someone after the 3rd stop?

Not all drunks are held until they sober up. It has nothing to do with the law and everything to do with police staffing. Most depts are not equipped to have an officer sit in the booking room until the drunk is sober. And most jails will not hold the drunk for very long due to limitted space. Jails will call for a sober ride almost immediately or until the drunk is an .07. Of course depends on the number of prior offenses and other charges at the time of arrest.

This should be a felony plain and simple. Law enforcement should be held accountable for things like this. I'm sure the public doesn't care if the jail is over crowded, just please do not send them back out to drive again. How much of this will we tolerate before changes are made?

Why would the cops be held accountable? The family member signed the form taking all accountability away from the police. I have no problem with changing drunk driving laws (which by the way was already done in 2010), but even then, the person who is responsible for the drunk, in this case the family member, should be held accountable.

To take someone to jail is going to take a cop off the street for at least an hour. In Milwaukee County, Its more like 2-3 hours. So now you have a shortage in manpower to cover the road and depending on your community, that could cut your manpower in half or by a third or fourth, which (on 3rd shift) is huge based in the geographic size of some communities. Increases in police force sizes would be in increase in taxes. Menomonee Falls by the way has not had in increase in police since the 70's, and recently lost 1 position a few years ago.

Then there are the State and federal guidlines regarding jail populations so throwing arrestees in jail on an ordinance violation is not a first choice IF there are no other factors. You could increase the size and staffing of jails, but that too would increase taxes.

I'm all for tougher penalties and taking everyone to jail, just remember its not as simple as "who cares, just lock em up".

Bottom line is that a person who was drunk was driving twice in one night even after being caught. There are no excuses or reasons for allowing that. Anyone who handled him is responsible. Keeping our people safe from drunk drivers should be a high priority well above most things mentioned. We lost more lives this last weekend to drunk driving. Enough is enough.

The policy of most PD's and the law is the release to responsible party. OWI 1 is a ordinance violation ,2,3, sometimes 4 are just misdemeanors unless there are extenuating circumstances. Time to toughen the laws and make it a mandatory 12hr hold or until they blow below a .02 before release.
I am sure this sort of incident happens more than we hear about.

Solve overcrowding by laying off the marijuana users and cracking down on the drunks who actually kill people. I'm not saying pot is ok, but it causes no deaths while drunk drivers cause many! Congrats to Milwaukee's sheriff for cracking down every weekend!

Forced her out of the vehicle? What? Someone tried that with me...if I agreed to pick them up and not leave them there all night...and the KEYS to the vehicle would be the first thing I took OUT of the vehicle with me, along with my cell phone to call OCPD to tell them there was a drunk stumbling alongside the road and to come pick him up....
