Oak Creek Man Allegedly Drove Drunk With Child in Van

Man spotted swerving between lanes on I-43.

An Oak Creek man is facing possible prison time after he was arrested New Year's Day for driving drunk with a 10-year-old girl in the back of his van.

Jose A. Garcia, 54, was charged in Milwaukee County Circuit Court Thursday with one count of third-offense operating while intoxicated with a child in the car and one count of driving with a prohibited alcohol concentration. If convicted, he could face up to two years in prison and $4,000 in fines.

A Milwaukee County sheriff's deputy spotted Garcia swerving between lanes while driving northbound on Interstate 43 on Jan. 1. Garcia told the deputy he drank a few glasses of wine earlier in the day.

Garcia failed field sobriety tests and had a blood alcohol level of 0.124 at the time of the incident. He was previously convicted of drunken driving in 1992 and 1996.
