4th OWI for Man Driving with His Daughter

Oak Creek police arrested the man earlier this month for driving drunk with his 10-year-old daughter in the car.

A 47-year-old Milwaukee man was arrested in Oak Creek for his fourth drunken driving offense in five years, this time with his 10-year-old daughter as a passenger, according to court documents.

The man, whom Patch is not naming to protect the identity of his daughter, was charged May 15 with two felony counts related to operating while intoxicated fourth offense with a minor as a passenger. He entered a not guilty plea during a court appearance on May 28, according to online court records.

If convicted, he faces up to 12 years imprisonment, $20,000 in fines, or both. The charges carry a minimum of one-year imprisonment and $1,200 in fines.

According to the criminal complaint:

On May 13, Oak Creek police say they saw the man drive through a red light at the intersection of Howell Avenue and Ryan Road.

An officer conducted traffic stop, during which the man slurred his speech, seemed confused and smelled of alcohol. He performed poorly during field sobriety tests and registered a 0.06 blood alcohol content on an Intoximeter test.

Though the legal limit in Wisconsin is a 0.08 blood alcohol content, the man has three prior OWI convictions, which prohibit him from driving with a BAC greater than 0.02.

He was charged with OWI in 1991, 2000 and 2010. He is due in court June 14 for a scheduling conference, and is out of custody after posting a $1,500 cash bond, according to online court records.
