Oak Creek Police Arrest Man For 6th OWI

A 54-year-old pulled over for speeding Wednesday now faces a felony drunken driving charge.

A 54-year-old Franklin man is facing his sixth drunken driving charge after he was pulled over for speeding through Oak Creek Wednesday.

Bert W. Johnson was charged in Milwaukee County Circuit Court Thursday with sixth-offense operating while intoxicated. If convicted, he faces up to six years in prison and $10,000 in fines.

On Wednesday, an Oak Creek police officer on patrol spotted Johnson doing 50 mph in a 35 mph zone on W. Puetz Road. When Johnson passed two cars and cut back into his lane to avoid a collision with an oncoming vehicle, the officer pulled him over on 27th Street.

Johnson smelled of alcohol and had slurred speech. He first denied drinking, then said he had one beer.

He failed field sobriety tests and had a blood-alcohol level of 0.03, which is above the 0.02 he's allowed due to past OWI convictions.

Johnson was previously convicted of OWI in 1992, twice in 1993, once in 1997 and 2001. He's currently in custody on a $5,000 signature bond while awaiting trial.
