Unconscious Behind the Wheel, Oak Creek Man Fields 3rd OWI

After receiving a report of a man asleep behind the wheel holding up traffic, police arrested a 44-year-old man for drunken driving at nearly four times the legal limit.

An Oak Creek man has been arrested and charged with his third drunken driving offense after police found him unconscious behind the wheel and at nearly four times the legal limit.

David Tilley, 44, was charged in Milwaukee County Circuit Court with third-offense drunken driving, operating with a prohibited blood alcohol content and bail jumping. If convicted, he could face up to two years and nine months imprisonment, $14,000 in fines, or both.

At 8:17 a.m. June 27, dispatchers received a 911 call about a driver asleep behind the wheel and holding up traffic at the stoplights at 13th Street and Puetz Road, according to the criminal complaint.

Police found the car pulling into a municipal building in the driveway at 800 W. Puetz Road.

An officer knocked on the driver side window for several minutes, but the driver was unresponsive. The officer opened the door to the car and the vehicle began rolling forward. The officer reached for the ignition and yelled for the now awake driver to put his foot on the brake, which he did, according to court documents.

Police say the man smelled of alcohol and slurred his speech. He denied drinking before driving, court documents say. 

He failed sobriety tests and registered a 0.28 blood alcohol content during an Intoximeter test, authorities say. 

Tilley is due in court July 8 for an initial appearance, according to online court records.
