Undercover Investigation Leads to Drug Charges

23-year-old man allegedly sold marijuana to undercover Oak Creek cops.

A 23-year-old Milwaukee man allegedly sold marijuana to undercover Oak Creek police officers and now faces three felony drug charges in Milwaukee County Circuit Court.

Jose R. Guerrero was arrested Feb. 12 after the Oak Creek Police Department's investigation. He has been charged with two counts of delivery of a controlled substance and one count of possession with intent to deliver.

Each of those counts carries a maximum sentence of three years, six months and a $10,000 fine.

According to a criminal complaint:

Undercover officers twice purchased marijuana from Guerrero at gas stations in Milwaukee.

On Feb. 12, officers working undercover arranged to again meet with Guerrero, this time near 6th and Rawson in Oak Creek.

Police saw his vehicle swerve out of its lane and then cross all three lanes to enter a parking lot at 841 W. Rawson Ave.

As the vehicle pulled into the lot and officers initiated a traffic stop, they saw Guerrero throw a bag of what appeared to be marijuana out the window.

Police ordered Guerrero out of the car. They recovered another bag of marijuana in the glove compartment. The substance in that bag and the one thrown out the window tested positive for marijuana.

In an interview with police, Guerrero admitted he sold marijuana to the officers and was going to do it again Feb. 12 before he was pulled over.

He also said he had drug-related charges in Nevada for transporting controlled substances.

Guerrero is due back in court March 15 for a scheduling conference, according to online court records.
