Report: Lawsuit Seeks To Stop Meijer Store in Oak Creek

A Milwaukee attorney says Meijer stores proposed in Kenosha and Oak Creek would hurt residents and were not properly approved.

An attorney has apparently made good on a lawsuit he threatened to file in June over the Meijer store planned for Drexel Town Square. 

Joseph Cincotta has filed a lawsuit on behalf of Oak Creek resident Dan Vitek and another seeking to stop a Meijer store proposed in Kenosha, alleging the stores will hurt residents and were not properly approved by local governments, according to a report in the Milwaukee Business Journal


Cincotta raised legal issues at a June 18 public hearing pertaining to the proposed zoning district, which has since been approved. He also criticized Meijer's inclusion in the plans as a "dramatic change" from the original proposal, which did not show a big box store.

Officials aren't commenting on the suit, but Wispark President Jerry Franke and Oak Creek City Attorney Larry Haskin disputed claims Cincotta made at the public hearing, saying the city and developers have followed proper legal procedures.

Cincotta has a history of challenging Meijer stores, filing lawsuits against proposals in Grafton and Sussex. Both of those suits were dismissed. 

The Meijer store in Oak Creek would be built on the east end of the 85-acre Drexel Town Square site at the corner of Drexel and Howell avenues. 

Plans also call for restaurants, apartments, a new city hall/library, and a "Main Street" featuring first-floor shops and second-floor apartments leading to a town square.
